These Terms and Conditions (“Agreement”) are entered into by and between the submitting artist (“Artist”) and Black Art Magazine (“Magazine”). By submitting artwork to Black Art Magazine, the Artist agrees to the following terms and conditions:
Interviews:
In addition to artwork submissions, Black Art Magazine may conduct interviews with artists for publication in the Magazine. Artists selected for interviews will not be required to pay any fees for participation.
Eligibility:
Submissions and interviews are open to artists of all backgrounds and experience levels.
Artwork must align with the Magazine’s focus on Black art, culture, and experiences.
Artists retain full ownership of their submitted artwork.
Submission Process:
Artists must submit their artwork through the designated submission platform provided by Black Art Magazine. Those selected for interviews will be contacted directly by the Magazine’s editorial team.
Each submission must include accurate and complete information, including but not limited to the title and description of the artwork.
Acceptance Criteria:
All submitted artwork will be accepted for consideration unless it is deemed offensive, graphic, inappropriate, or violates any applicable laws or regulations.
The Magazine reserves the right to reject any artwork that, in its sole discretion, is not aligned with its values or may be considered inappropriate for publication.
Definition of Inappropriate Content:
Inappropriate content includes but is not limited to artwork that contains explicit nudity, violence, hate speech, or any form of discrimination.
The Magazine will not accept artwork that violates copyright laws or any other intellectual property rights.
Selection Process:
The Magazine’s editorial team will review all submissions and conduct interviews with selected artists.
Selections will be based on artistic merit, relevance to the Magazine’s themes, and overall quality.
The Magazine reserves the right to accept or reject any submission or interview at its sole discretion.
Decision and Communication:
The Magazine will communicate the decision to accept or reject the submitted artwork promptly after the review process.
Notification:
Artists whose submissions are accepted will be notified via the contact information provided during the submission process.
The Magazine is not obligated to provide feedback on rejected submissions.
Appeals:
Artists have the right to appeal the rejection of their artwork by providing additional context or information.
Appeals must be submitted in writing within one week of receiving the rejection notification.
Publication:
Artists whose submissions are accepted grant Black Art Magazine a non-exclusive license to publish, reproduce, and distribute the artwork in connection with the Magazine’s print and digital publications.
The Magazine may also feature the artwork on its website and social media platforms with appropriate credit and captioning.
Promotion:
Artists agree that the Magazine may use images of the submitted artwork for promotional purposes, including but not limited to promotional materials, social media, and press releases.
Payment and Compensation:
Artists will not receive monetary compensation for the publication of their artwork.
Submission fees (if applicable) are not refundable if the artwork is accepted for publication.
Copyright:
Artists retain full copyright and ownership of their submitted artwork.
The Magazine will not reproduce or distribute the artwork beyond the scope of the agreed-upon publication without the Artist’s explicit consent.
Indemnification:
Artists agree to indemnify and hold Black Art Magazine harmless from any claims, damages, or liabilities arising from the submission or publication of the artwork.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.
Dispute Resolution:
Any disputes arising under this Agreement shall be resolved through mediation or arbitration conducted in accordance with applicable laws and regulations. The parties shall mutually agree on a mediator or arbitrator, or if they cannot agree, the mediator or arbitrator shall be appointed by the appropriate court or authority in the State of Georgia, United States. The prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs incurred in connection with such dispute resolution.
Severability:
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall not be affected and shall remain in full force and effect.
By submitting artwork to Black Art Magazine, the Artist acknowledges that they have read, understood, and agreed to abide by these Terms and Conditions. The Magazine reserves the right to modify these terms at any time without prior notice.
